Donor: the individual making a financial donation to Coed Caerdydd.

If any provisions of these terms and conditions are held to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions.
These terms and conditions constitute the entire agreement between you and Cardiff Council and supersede all other communications and proposals, whether electronic or written, between the user of the website and Cardiff Council.
Any failure of Cardiff Council to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights.

Making a donation
By donating, you agree to make a monetary gift to Cardiff Council for the purpose(s) stated on the website under the Coed Caerdydd project which is being donated to.
100% of your donation will go towards local initiatives. All monies donated through Ardal CWB will incur no admin cost.

Donations may only be made by those who are the account holder(s) of the account from which the donation is made, or by someone who has the permission of the account holder(s) of the account from which the donation is to be made.
Taxation
Donations are not subject to Value Added Tax (VAT).
Gift Aid
Cardiff Council is not a registered charity in England and Wales. Therefore, any donations will not have the benefit of Gift Aid.
Your Personal Information
All personal data held by us or on our behalf is held in accordance with Cardiff Council’s Privacy Policy.
Refunds
If you donate, you are entitled to a full refund of the monies within 14 days of the date on which your donation was made. Should you require a refund, please send an email to coedcaerdyddproject@cardiff.gov.uk and provide the donation reference number, which will be included on your electronic receipt.
Refusal of Donations
We reserve the right to refuse donations made which are:
- Unlawful (e.g. donations made using proceeds of crime) or not in accordance with the policies of Cardiff Council
- Made by someone who, at the time of donation, lacked mental capacity to make such a donation
- Not in accordance with the aims and purposes of the project, which can be found on the website
Limitation of liability
We will not be liable for any direct, indirect or consequential damages (even if foreseeable) whether based on contract, tort or otherwise, to the fullest extent permitted by law. This includes but is not limited to liability for: loss of data or profits; interruptions or delays to the website; the provision of or failure to provide services; any information, material, goods and services obtained through the website; or otherwise arising out of your use of the website.
Force majeure
Cardiff Council will not be in breach of its obligations under these terms and conditions, nor liable to any user of the website for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control. This includes but is not limited to any act of God, strike, trade dispute, act of terrorism, act or omission of government or regulatory bodies.
